ASSISTANT CITY ATTORNEY

Classification Summary: The primary function of an employee in this class is to provide perform advanced professional legal representation, primarily involving civil litigation. Work may be focused in such areas as City Code amendments and formatting; public works contracts, forms, procedures and disputes; encroachment permits and the use of the City's rights of way and easements; property acquisitions; land use; public housing; issues involving Public Safety; environmental issues; water and wastewater; water rights; franchises; and general city issues. Work also includes prosecutorial duties when directed by the City Attorney, and rendering legal opinions for City officials, departments, boards, commissions, and at various meetings.

They are intended to be accurate summaries of what the job classification involves and what is required to perform it. Employees are responsible for all other duties as assigned. May concentrate duties in a specialized area for the Law Department such as City Code amendments; water rights; Public Works contracts, forms, procedures and disputes; encroachment permits and the use of the City's rights of way and easements; property acquisitions; land use; public housing; Police Department issues; environmental issues; water and wastewater; franchises; and City departmental contracts, forms and disputes; Litigates civil and/or criminal court cases; Litigates forcible detainers and evictions from public housing; Researches legal precedents, federal laws, state statutes, state and federal regulations and City ordinances, and represents the City's interest in trial and appellate courts; Attends and gives legal opinions in various meetings, including City Council meetings, and advises department heads and City officials and representatives on legal problems and questions; Acts as legal advisor to various City boards and commissions that are critical to the operation, principles and culture of the City; Prosecutes criminal cases before the municipal court and appeals from the municipal court to superior court and other courts of record; When directed, assists the City Attorney in the operation of the legal department; Represents City department heads before the Merit System Boards and similar boards of hearings, when directed; Represents the City in acquisition of property through negotiated purchase or condemnation proceedings; Responds to communications from the public relative to legal matters affecting the City; When directed, acts for the City Attorney in his/her absence; Assists in the preparation and administration of the departmental budget; Enforces City policies in regard to land use, water issues, jurisdictional problems, and other City interests; Drafts and reviews City's contracts, intergovernmental agreements, development agreements, resolutions, leases, ordinances, regulations, and related documents; Negotiates and represents the City during discussions with third parties and regulatory agencies on a wide variety of agreements, settlements, rule-making proceedings and enforcement actions taken by or against the city; Investigates claims and complaints by and against the City and makes or reviews findings regarding such claims; Conducts research of legal precedents, federal laws, state statutes, and city ordinances, prepares civil court cases in trial or administrative hearing; Represents the City in negotiations to settle water rights claims of the tribal communities, in tribal water rights adjudication; in environmental litigation (Endangered Species Act, National Environmental Policy Act); and in Colorado River Water and Central Arizona Project-related litigation; Negotiates and drafts agreements regarding domestic water delivery, water transportation, reclaimed water sale and exchange, use of wells, and related issues; Negotiates license agreements with telecommunications and cable companies; Assist City in proposing or responding to legislative action regarding telecommunications, water-related issues, and other issues affecting the City; Pursues bankruptcy claims and represent the City's interest in court; Enforces City policies regarding land use, water and wastewater issues, nuisance, jurisdictional issues, and other city interests; Answers communications from the public and makes or reviews presentations to the public relative to matters affecting the City; Advises and/or trains Police command staff and officers in areas such as civil liability and personnel matters and employment law, property issues, contracts, laws of arrest, search and seizure, civil conflict and records requests; Revises Police general orders; Coordinates litigation for the City; supervises outside Counsel, obtains documents and information for discovery requests; coordinates City employee interviews and depositions; and attends depositions; Prosecutes civil actions for the enforcement of forfeiture laws, public nuisance laws, vehicle impound laws and anti-gang laws; Litigates issues involving property in police custody; Litigates issues arising pursuant to public records laws; Performs all work duties and activities in accordance with City policies and procedures; Works in a safe manner and reports unsafe activity and conditions. Follows City-wide safety policy and practices and adheres to responsibilities concerning safety prevention, reporting and monitoring as outlined in the City's Safety Handbook. Other Duties and Responsibilities: Some positions are on call 24 hours, seven days a week.
Knowledge, Skills and Abilities: Knowledge of: General municipal, state and federal laws affecting city government; City ordinances, particularly those relating to the authority and functions of City departments; Specialized legal areas of emphasis, such as environmental law, public utility law, Indian law, land use, rural property and conveyance, Police operations and POST certification, telecommunications and cable service providers, public rights of way, eminent domain and other specialties; Legal research; State and federal court rules; Procedural rules of regulatory agencies; Established precedents and sources of legal references applicable to City activities; Operation of standard office equipment including a personal computer and job-related software applications; Contemporary negotiation techniques and methods; English grammar and punctuation.
Ability to: Analyze, appraise, and organize facts, evidence, and precedents in determining the various aspects and alternatives of cases; Present material to opponents and develop an appropriate defense; Make significant/substantial legal decisions in individual cases based on a combination of factors including the law, policy and rules of ethics; Negotiate complex legal issues; Bring opposing parties to consensus; Discern critical issues and needs of the City through a negotiations process; Communicate effectively, both orally and in writing, for purposes of advocating, persuading, negotiating, and counseling for or on behalf of the City; Analyze, appraise, and organize facts and precedents and to present such material in a clear and logical form; Develop alternative courses of action, and possible courses of action of opponents; Present and argue cases and to handle unanticipated problems smoothly and effectively; Establish and maintain effective working relationships with other City employees, supervisory personnel, state and local elected officials, and the public; Operate standard office equipment and a personal computer using program applications appropriate to assigned duties; Demonstrate integrity, ingenuity, and inventiveness in the performance of assigned tasks; Use logical and creative thought processes to develop solutions according to written specifications and/or oral instructions.
Supervision Received: The work is performed under the supervision of the City Attorney.

Minimum Qualifications: Graduation from a School of Law accredited by the American Bar Association with a Juris Doctorate Degree; License to practice law in the State of Arizona in the United States District Court for the State of Arizona and the United States Circuit Court of Appeals; and Eight (8) years experience in the practice of law, including some experience in municipal law or related area with an expertise in specialty areas of the practice of law as determined by the City Attorney; and Membership in good standing in the Arizona State Bar Association or Any equivalent combination of experience and training which provides the knowledge and abilities necessary to perform the work.
Work Environment: The primary duties of this class are performed in a general office setting, in court and in regulatory agencies.
