Job Description
ASSISTANT CITY PROSECUTOR I/II    

Pay Grade: 27 (I); 29 (II)            FLSA Status:    Exempt

Classification Summary:
The primary function of an employee in this class is to provide legal representation primarily involving misdemeanor criminal litigation including violations of City ordinances and Arizona Statutes. Assist the City Prosecutor in the prosecution of cases within the jurisdiction of the City, which includes all violations of the City Charter, ordinances, and Arizona statutes. Work also includes participation in research and administration of civil matters and consultation in code and rule development. The Assistant City Prosecutor I is distinguished from the Assistant City Prosecutor II by the more advanced level of trial work performed. The Prosecutor I’s are given extensive orientation in criminal prosecution activities and the various components of the criminal justice system.

Essential Functions:

Conducts pretrial conferences with defendants and defense counsel to discuss a case and negotiate an appropriate plea, discuss discovery and interview requests, meet with victims, and set a trial date;
Responds to oral or written defense motions, appeals, and special actions after researching and analyzing the facts of the case, the statutes, case law, rules of evidence, and criminal procedures;
Makes charging decisions following review and evaluation of police reports in light of applicable law;
Communicates with victims, explaining their rights at all stages of the criminal proceedings, getting their input regarding the impact of the crime against them, restitution options, and sentencing recommendations;
Conducts oral arguments at appellate court levels on appeals and special actions; conducts trials de novo in Superior Court; conducts Rule 11 proceedings to determine the competency of a defendant to stand trial;
Assists the Assistant City Attorneys by appearing at Impound hearings and Interpleader actions when necessary;
Instructs and advises other City departments on the law and proper procedures;
Prosecutes cases in other jurisdictions that are classified as “conflict cases”;
Conducts community education to civic groups and students on mock trials and the law and criminal process;
Trains police officers in methods for conducting detailed investigation and written documentation of the investigation; advises them on specific investigations and prepares them for trial;
Prosecutes misdemeanor criminal cases;
Appears without assistance against accused in a court of law and presents evidence before a judge or jury;
Analyzes evidence in criminal cases;
Interviews police officers, inspectors, or witnesses for the state to ascertain that evidence is complete and will be well presented;
Confers with defense attorneys and/or victims and negotiates agreements when it is in the best interest of the state;
Advises the Police Department on gathering and presentation of evidence, filing of charges, and other legal matters related to criminal cases;
Researches and drafts memoranda and appeal briefs of matters appealed from Chandler City Court;
Reviews adopted and proposed laws, ordinances, codes, rules, and regulations and advises appropriate officials of action to be taken;
Provides statistical data concerning disposition of cases;
Prepares legal opinions, memoranda, and data on various subjects as requested;
Discusses case results with superiors to evaluate and improve performance for future trial work;
Participates in ongoing legal education to remain up-to-date on criminal and civil law;
Analyzes, appraises, and organizes facts and precedents to present in a clear and logical form;
Determines alternative courses of action, and possible courses of action of opponents;
Presents and argues cases to handle unanticipated problems smoothly and effectively;
Establishes and maintains effective working relationships with other City employees, supervisory personnel, state and local elected officials, and the public;
Demonstrates integrity, ingenuity, and inventiveness in the performance of assigned tasks;
Uses logical and creative thought processes to develop solutions according to written specifications and/or oral instructions.
Performs all work duties and activities in accordance with City policies, procedures;
Works in a safe manner and reports unsafe activity and conditions. Follows City-wide safety policy and practices and adheres to responsibilities concerning safety prevention, reporting and monitoring as outlined in the City’s Safety Handbook.

Knowledge, Skills and Abilities:
Knowledge of:
City, state and federal laws which relate to the criminal prosecution of suspects;
Judicial procedures and the rules of evidence;
Established precedents and sources of legal references applicable to criminal cases;
Procedures and practices followed by law enforcement agents;
Municipal government and the procedures and practices of municipal law;
Current research techniques;
Operation of standard office equipment including a personal computer and job-related software applications;
English grammar and punctuation.

Ability to:
Make significant and substantial independent legal decisions in individual cases based on a combination of factors including the law, policy, and rules of ethics;
Communicate effectively, both orally and in writing;
Delegate work to support staff and police officers, as needed;
Analyze, appraise, and organize facts, evidence, and precedents and to present such material in a clear and logical form;
Stay current on criminal law issues;
Determine alternative courses of action, and possible courses of action of opponents;
Present and argue cases in court and to handle unanticipated problems smoothly and effectively;
Establish and maintain effective working relationships with other City employees, supervisory personnel, state and local elected officials, and the public;
Operate standard office equipment and a personal computer using program applications appropriate to assigned duties;
Demonstrate integrity, ingenuity, and inventiveness in the performance of assigned tasks;
Use logical and creative thought processes to develop solutions according to written specifications and/or oral instructions.

Supervision Received:
The work is performed under the supervision of the City Prosecutor.

Supervision Exercised:
Supervises and evaluates the work of clerical personnel.

Minimum Qualifications:
Assistant City Prosecutor I:
Recent graduation from a school of law accredited by the American Bar Association with a Juris Doctorate Degree; and
Membership in good standing in the Arizona State Bar Association.
Assistant City Prosecutor II:
Graduation from a School of Law accredited by the American Bar Association with a Juris Doctorate Degree; and
Two (2) years as a criminal trial attorney which includes experience in legal research; and
Membership in good standing in the Arizona State Bar Association; and
Prior experience in prosecutorial trial work in the State of Arizona is preferred.

Work Environment:
The primary duties of this class are performed in a general office environment.

Essential Physical Abilities:
Sufficient clarity of speech and hearing or other communication capabilities, with or without reasonable accommodation, which permits the employee discern verbal instructions and to communicate effectively in person, on a telephone, and in a courtroom environment;
