Extension of Premises

The City of Chandler recognizes the challenges that capacity limitations implemented in response to COVID-19 has created for businesses. In order to support businesses as they adjust to these limitations, the City has made it easier than ever for businesses to expand their capacity. In October, City Council streamlined the approval process for extensions of premises by allowing the City Manager or designee to approve and waive fees for extensions of premises, in an effort to better respond to the needs of Chandler businesses. 

There are different ways to expand capacity, depending on your business. Please see the options below for more information and to determine which option applies for your business.
 

Safest Outside Restaurant Assistance Program

On Dec. 2, 2020, Governor Ducey issued Executive Order 2020-60 enabling Arizona businesses to temporarily extend liquor licenses into expanded outdoor dining spaces for the purposes of mitigating COVID-19 and announced financial assistance programs with the Arizona Restaurant Association and Arizona Lodging and Tourism Association to help restaurants, hotels and other dining establishments expand outdoor dining options and strengthen sanitation practices.

The City of Chandler is pleased to introduce the On the Street program, which allows business to expand their premises into on-street parking. To be eligible to participate in the On the Street program, businesses must meet the following criteria:

  • Street patios may only be located on streets with a speed limit of 25 miles per hour or lower, with no more than one travel lane in each direction (excluding center turn lanes); and with designated on-street parking.
  • Eligible establishments must have street frontage on the ground floor of a building.
  • Establishments that participate must be allowed to operate in-store service, per Arizona Department of Health and the Governor’s Office.

Businesses must submit an application to and receive approval from the City prior to participation in the On the Street program.

Temporary Sales and Promotional Event (TSPE) is a special event or combination of special events using private property to display and sell merchandise customarily sold in a store on the premise or activities promoting a special event, product, merchandise or other promotion including, but not limited to grand openings, change of business ownership, business anniversaries and other events on private, nonresidential property. Please note that TSPE’s typically take up to two weeks to review and process and that applicants are requested to submit their application 30 days prior the day or days the permit is needed for. Businesses with existing patios looking to temporarily expand their premises on private property should utilize this permit.

Please note that, in response to COVID, the City is currently allowing TSPE’s to last longer than 48 days in a calendar year:

If the business serves alcohol, additional permits will be required, depending on the design of the expanded premises. If the patio is contiguous to the existing premises, the business should apply for a temporary extension of premises with both the City of Chandler and the Department of Liquor Licenses and Control. The Department of Liquor Licenses and Control requires that the City sign off prior to its approval, so please contact the Tax and License Division at the City of Chandler during this process. If the business intends to build a temporary, non-contiguous extension of premises, it will need to seek a permanent extension of premises from both the City and Department of Liquor Licenses and Control. Again, please contact the Tax and License Division at the City of Chandler in this process.

Businesses may choose to expand their capacity permanently during COVID-19. This may come in the form of an expanded patio or other change to the permanent business footprint. If this is the case, businesses should contact the Planning Department to begin the process. This applies to businesses expanding permanently both on private and public property.
